We believe the cap on broadband fees is bad policy because it was part of the larger effort to protect incumbent broadband providers by prohibiting competitive providers from setting the prices for broadband. That effort has long since failed. The purpose of the $10.25 cap on broadband fees was never to promote competition, and the FCC doesn’t actually believe that it was. Instead, the $10.25 cap was intended to punish ISPs for competitively offering their products and services at prices below the $10.25 cap. It was not designed to benefit consumers, or even broadband customers. It was designed to protect a few favored incumbent broadband providers from competition. That point has been well-explained by the National Cable and Telecommunications Association in its comments on the FCC’s recent net neutrality proceeding. NCLBAT said that net neutrality rules are not necessary because “there are no states that do not have some form of net neutrality rules,” and that NCLBAT supports “the continued efforts by policymakers at the federal level to craft net neutrality rules.”
